USER DATA DELETION POLICY

Purpose and Scope:

  • This policy sets out the purpose and scope of the user deletion policy.

  • The policy applies to all users across of the App whether Tradespeople or end users of the multi-user App.

Data Retention Period:

  • All data will be held by Trades’ Up Ltd (Trades’Up) for a period of 7 years from the time a Tradesperson or user either last uses the App or otherwise de-activates his, her or its account with Trade’s Up, as the case may be.

User Deletion Requests:

  • A Tradesperson or user may request Trades’Up to remove his, her or its data held by Trades’ Up at any time. Upon Trades’Up receiving any such request, Trades’ UP shall promptly delete the data unless it receives professional advice that it should not remove the data.

  • If Trades’Up receives professional advice that it should not delete the data, it will as promptly as is practical in the circumstances, advise the Tradesperson or user that it has received advice not to delete the data and any reasons it has been provided for not deleting it.

  • All requests that may be made for deleting the data shall be made via email message to support@tradesup.co.nz.

Audit Logging:

  • A log for user data deletion requests shall be held by Trades’Up but on any data being deleted, Trades’Up may, in its sole discretion, remove the data deletion request from its log.

  • Trades’Up shall ensure that logs are securely stored and accessible only to authorised personnel of Trades’Up or its professional advisers.

Data Security:

  • The security measures in place to protect the data of Tradespeople or used data during deletion include only authorised personnel i.e. Director or Developer of Trades’ Up having the right to access the database and delete the data.

  • Trades’Up shall ensure any data that is to be deleted is permanently deleted from its database by using industry-recognised data removal protocols and using its best endeavours to ensure that data is not accidentally or maliciously accessed after deletion.

Legal and Regulatory Compliance:

  • The user deletion policy is designed to comply with relevant privacy laws and regulations, such as the (New Zealand) Privacy Act 2020 and any regulations made thereunder, or any amendments made to either the Privacy Act 2020 or regulations made thereunder from time to time.

  • Notwithstanding any other provisions in this user data deletion policy, Trades’Up shall cooperate with all statutory or regulatory authorities having jurisdiction thereover, when necessary.

Training and Awareness:

  • Trades’Up shall ensure appropriate personnel are adequately trained on its user deletion policy and its implementation and use.

  • Trades’ UP shall encourage a culture of data protection and privacy within the organisation.

Monitoring and Review:

  • The data deletion policy will be periodically reviewed and updated to comply with changing laws and industry standards.
